This document establishes the general contracting conditions applicable to commercial transactions carried out through the website atenda.tic.gal, owned by “TICGAL”, with Tax Identification Code B94165495, whose address is Calle Fernando II, number 1, staircase 2, ground floor, door 1, 36003 Pontevedra, Galicia, Spain. These conditions have been drawn up in compliance with current consumer and user regulations in Spain, with the aim of guaranteeing transparency and protection of consumer rights.

Themainpurposeofthisdocumentistoinformusersaboutthetermsandconditionsthatregulatethe purchase process, the payment methods available, the guarantees offered or the resolution ofconflicts,amongothers,inaccordancewiththeprovisionsofcurrentlegislation.

  1. Subject matter and scope

These General Conditions regulate the access, browsing and use of the website www.atenda.tic.gal (hereinafter “the shop”), as well as the responsibilities arising from the acquisition of software licenses offered through it. The use of the online shop implies acceptance of these General Terms and Conditions by the user.

Access to the shop is permitted to any person over 18 years of age, acting as a final consumer, in accordance with the legislation applicable in Spain.

  1. Information on products and services

Description: The products offered in the shop include software licenses, in particular GLPI plugins developed by “TICGAL”, each with detailed description about their features, characteristics, compatible versions, price and taxes included.

Availability: All products are subject to availability. In the event of access or download problems, “TICGAL” undertakes to notify the customer as soon as possible and provide a solution.

Prices: The prices indicated in the online shop include VAT and any other taxes applicable in Spanish territory. “TICGAL” reserves the right to modify prices at any time. However, the products will be invoiced on the basis of the rates in force at the time of order confirmation.

Discounts, promotions and special offers will be subject to the specific conditions indicated in each case and will be available until the date indicated or while stocks last.

  1. Purchasing process

The purchasing process on our platform is designed to be simple and transparent, ensuring a satisfactory experience for the consumer. Below are the steps to follow to make a purchase:

    1. Selection of Licenses: The consumer can browse our catalogue of software licences available on the website atenda.tic.gal. Each software licence has a detailed description, price and availability.

    2. Add to Cart: Once the desired software licence has been selected, the consumer must click on the “Add to Cart” button. The consumer can continue browsing and add more licences to the cart if desired.

    3. Cart Review: Consumers can review their shopping cart at any time by clicking on the cart icon. Here he can check the selected software licences, change quantities or delete items before proceeding to checkout by clicking on the “Update Cart” button.

    4. Discounts: If applicable, the consumer can apply discounts in the section “Apply Coupon”.

    5. Provide the invoicing data: The consumer must provide the invoicing data and the data requested for the formalisation of the order.

    6. Order Review and Confirmation: Before proceeding to payment, the consumer will have the opportunity to review all details of his order, including software licenses, quantities and prices.

    7. Payment: The consumer will proceed to the payment section, where he/she will be able to choose from the available payment methods. It is important that the consumer reviews the conditions of each payment method before confirming the transaction.

    8. Order Confirmation: Once payment has been completed, the consumer will receive an order confirmation at the email address provided. This confirmation will include a summary of the order.

This process is designed to comply with current consumer and user regulations in Spain, ensuring the protection of consumer rights at every stage of the purchase.

  1. Delivery

The delivery of software licences is digital and a download link or the corresponding access credentials will be provided upon confirmation of payment. The consumer will receive by email all the information necessary to access the product.

  1. Methods of payment

At “TICGAL”, we offer our customers various payment options to facilitate the purchasing process. The following payment methods are available:

    1. Credit/Debit Card: We accept all major credit and debit cards, including Visa, MasterCard and American Express. Payment will be processed securely through our payment gateway, ensuring the protection of customer data.

    2. Bank Transfer: Customers may choose to pay by bank transfer. Once this method has been selected, the bank details required to complete the transaction will be provided. It is important that the customer includes the order number as a reference on the transfer to ensure correct identification of the payment.

It is important to note that all payments must be made in Euros (€). Orders will not be processed until confirmation of payment has been received.   1. Invoice

In compliance with current consumer and user regulations in Spain, “TICGAL” will provide the consumer with an electronic invoice for each purchase made. This invoice will be sent to the email address provided by the consumer at the time of placing the order.

However, the consumer has the right to request and receive the invoice in paper format. This right is guaranteed in accordance with the provisions of article 63.3 of the LGDCU. It is important to highlight that the consumer and user’s right to obtain the invoice in paper format will not be conditioned, in any case, to the payment of any economic amount.

“TICGAL” undertakes to send the invoice in paper format as soon as possible, thus ensuring compliance with consumer rights.

  1. Withdrawal policy

Exclusion of the right of withdrawal: In the case of the acquisition of software licences, which constitute digital content not supplied on material support, always with prior express consent, the consumer expressly waives his right of withdrawal from the moment he begins downloading or accessing the software, in accordance with article 103, section “m” of the LGDCU.

By accepting these terms, you expressly agree that once you have started downloading or accessing the software licence, you forfeit your right of withdrawal.

  1. Non-refund policy

Sales of software licenses of GLPI plugins developed by “TICGAL” through the shop are final and non-refundable. This is because the product is immediately available upon purchase and does not require the delivery of a physical key.

  1. Software warranty and support

“TICGAL offers maintenance and technical support for its GLPI plugins under the following conditions:

    1. Coverage:

The maintenance covers only the plugin in the purchased version, it does not include support for the GLPI ERP system or different versions of the plugin (major versions).

    1. Error resolution:

“TICGAL” will notify customers of bugs and enhancements affecting the version purchased and customers will be able to download updates from their subscription area while their subscription period is in effect.

    1. Renewal:

Beforetheendofthesubscriptionperiod,thecustomerwillreceiveanotificationtorenewwitha40%discount.Thevoucherwillbesentby emailandwillbevalidin-storeonly.

    1. Supported versions:

“TICGAL will align the support and maintenance of its plugins with Teclib’s official GLPI support, unless otherwise stated.

  1. Licences for use

Unless otherwise stated, plugins distributed by “TICGAL” through the shop are subject to the GNU/AGPLv3 license. This implies:

  • Reseller: Plugins can be resold as many times as desired to one or more customers. The support and maintenance included in the purchase of the plugins will only be valid for one plugin and one instance of GLPI. If the reseller wants more support for their end customers, they can purchase support separately.

  • Modifications:Theconsumer maymodifythesourcecodeoftheplugins,butinthatcase,hewilllosetherighttofreesupportandassistancefrom”TICGAL”.

Any breach of the terms of the licence may be punishable under applicable law.

  1. Technical support

“TICGAL offers technical support for plugins purchased through https://xes.ticgal.com or its mobile application for iOS and Android. The estimated response time is 72 hours, but normally the consumer will receive a response within one working day.

  1. Sponsorship of a new feature

Customers can request to upgrade any of the “TICGAL” plugins. To do so, they should use the form available on the support site: https://xes.ticgal.com, and “TICGAL” will contact them.

  1. Dispute resolution and jurisdiction

In the event of any dispute or conflict arising in connection with these legal conditions of sale, “TICGAL” undertakes to seek an amicable solution with the consumer, through a process of direct negotiation between the parties.

In the event that a satisfactory agreement cannot be reached, the consumer has the option of using the EU’s Online Dispute Resolution (ODR) platform, accessible via the following link: https://ec.europa.eu/consumers/odr. This platform offers an extra-judicial means of resolving disputes quickly and efficiently.

Any dispute arising from the interpretation or execution of these General Terms and Conditions shall be submitted to the jurisdiction of the courts of the consumer’s domicile.

  1. Modifications to the Terms and Conditions

“TICGAL” reserves the right to modify these General Terms and Conditions at any time. The modifications will be applicable as of their publication in the online shop. It is the customer’s responsibility to regularly review the current conditions before making a purchase.
